1. PRESENTATION OF THE ESTABLISHMENT
These General Terms and Conditions of Sale (hereinafter referred to as the "Terms and Conditions") govern the contractual relationship between:

(hereinafter referred to as the "Hotel" or the "Establishment")
and any individual or legal entity making a reservation (hereinafter referred to as the "Guest" or the "Client").
Any reservation made with the Establishment constitutes full, unconditional and irrevocable acceptance of these General Terms and Conditions of Sale.
These Terms and Conditions supersede and replace any previous version.
2. PURPOSE
These General Terms and Conditions define the respective rights and obligations of the parties in relation to reservations made:
-
directly with the Hotel;
-
through the official website;
-
by telephone;
-
by email;
-
through a travel agency;
-
via an online booking platform (including but not limited to Booking.com, Expedia, Hotels.com, Airbnb, or any other Online Travel Agency).
Where a reservation is made through a third-party distributor, that distributor's own terms and conditions shall also apply in addition to these Terms and Conditions.
3. RESERVATIONS
A reservation shall become final only after:
-
written confirmation has been issued by the Establishment; and
-
where applicable,
-
receipt of the required payment or valid credit card guarantee.
The Hotel reserves the right to refuse any reservation that is:
-
incomplete;
-
fraudulent;
-
made using an invalid payment card; or
-
considered to present a significant risk.
The Client guarantees the accuracy of all information provided when making the reservation.
Any errors or omissions in the information supplied shall remain the sole responsibility of the Client.
4. RATES
All prices are quoted in Euros (€).
Applicable Value Added Tax (VAT) is included unless otherwise stated.
Local tourist tax is not included, unless expressly specified.
Tourist tax is collected on behalf of the City of Cannes in accordance with the legal rate applicable on the date of the stay.
Rates may be modified at any time.
Only the price stated in the official booking confirmation shall be contractually binding.
5. MANIFEST PRICING ERROR
Room rates are automatically distributed through various software systems, including the Property Management System (PMS), Channel Manager, Online Travel Agencies (OTAs), and booking engines.
Despite the precautions implemented by the Establishment, an exceptional technical, material or human error may occur.
A manifest pricing error includes, but is not limited to:
-
an obviously incorrect or unreasonably low price;
-
a rate clearly inconsistent with the booked room category;
-
a decimal point error;
-
a technical, software or human input error.
In such circumstances, the Establishment reserves the right to:
-
offer the Client the corrected rate;
or
-
cancel the reservation and refund all amounts already paid.
No compensation or damages shall be payable where the pricing error was objectively obvious and could reasonably have been identified by the Client.
6. PAYMENT TERMS
Depending on the rate selected, the Establishment may require:
-
full payment;
-
a deposit;
-
or a valid credit card guarantee.
Payments may be made using:
-
Visa
-
Mastercard
-
American Express
-
Bank Transfer
-
Cash (within the limits permitted by French law)
The Establishment may provide the Client with a secure online payment link.
Failure to complete payment within the specified timeframe may result in the automatic cancellation of the reservation.
7. NO RIGHT OF WITHDRAWAL
Pursuant to Article L221-28 of the French Consumer Code, accommodation services provided on a specified date are not subject to the statutory right of withdrawal.
Accordingly, all reservations are firm and binding under the conditions of the selected rate plan.
8. CANCELLATION POLICY
Cancellation conditions vary depending on the rate plan selected at the time of booking.
Standard Periods (Outside Congresses and High-Demand Events)
Cancellation more than 30 days prior to arrival
No cancellation fee shall apply.
Cancellation between 30 and 15 days prior to arrival
50% of the total stay shall be charged.
Cancellation less than 15 days prior to arrival
100% of the total stay shall be charged.
Congresses, Festivals and High-Demand Periods
Including, but not limited to:
-
Cannes Film Festival
-
Cannes Lions
-
MIPIM
-
MIPCOM
-
ILTM
-
MAPIC
-
TFWA
-
Cannes Yachting Festival
-
The months of June, July and August
-
and any similar event or exceptional high-demand period.
Cancellation more than nine (9) months prior to arrival
No cancellation fee shall apply.
Cancellation between nine (9) and six (6) months prior to arrival
50% of the total stay shall be charged.
Cancellation less than six (6) months prior to arrival
100% of the total stay shall be charged.
No refund shall be granted in the event of:
-
No-Show;
-
early departure;
-
voluntary reduction of the booked stay.
9. CHECK-IN AND CHECK-OUT
Check-in
From 3:00 PM.
Check-out
No later than 11:00 AM.
Guests arriving late are kindly requested to inform the Establishment in advance.
Should the Hotel receive no communication from the Client by 1:00 AM on the day following the scheduled arrival date, the Establishment reserves the right to release the room in accordance with the conditions of the reserved rate plan.
Late check-out may be subject to additional charges.
10. NO-SHOW
Any reservation not honoured by the Client without prior notice shall be deemed a No-Show.
In such circumstances, the Establishment shall be entitled to charge the full amount due under the applicable booking conditions.
11. HOUSE RULES – GUEST CONDUCT
The Client agrees to respect the peace, safety and comfort of the Establishment, its guests and its staff at all times.
The Establishment is intended exclusively for tourist accommodation purposes.
Any use inconsistent with its intended purpose is strictly prohibited.
The following activities are expressly prohibited, including but not limited to:
-
organizing parties or receptions;
-
hosting private events;
-
holding unauthorized gatherings;
-
conducting commercial activities without the prior written consent of the Establishment;
-
engaging in any unlawful activity.
The Client shall remain fully responsible for their own conduct as well as for the conduct of all persons invited or accommodated by them.
The Establishment reserves the right to terminate the stay immediately, without compensation or refund, in the event of:
-
excessive daytime noise;
-
excessive nighttime noise;
-
aggressive or threatening behaviour;
-
verbal or physical violence;
-
possession, use or trafficking of illegal substances;
-
intentional damage to the property;
-
any behaviour affecting the comfort, safety or well-being of other guests or staff;
-
failure to comply with these General Terms and Conditions or the Establishment's internal regulations.
In such circumstances, the total amount of the stay shall remain fully payable.
12. EXTERNAL VISITORS
For security reasons, any person not included in the reservation shall be considered a visitor.
Visitors must:
-
be declared at Reception upon arrival;
-
present a valid government-issued identification document;
-
obtain prior authorization from the Establishment.
Visitors are permitted on the premises until 9:30 PM only.
After this time, access may be refused.
The Establishment reserves the right to limit or deny access whenever it considers such access to be incompatible with the safety, security, tranquillity of the premises or compliance with these General Terms and Conditions.
13. ROOM OCCUPANCY
The maximum occupancy of each room or apartment is strictly limited to the number of guests specified at the time of booking.
Any undeclared additional occupant may result in:
-
refusal of access to the room;
-
additional charges;
-
immediate termination of the stay without refund.
Minors must be accompanied at all times by their legal guardian or by an adult duly authorized to assume responsibility for them.
14. NON-SMOKING POLICY
The Establishment operates a strict non-smoking policy throughout the property.
Smoking is prohibited in particular:
-
inside guest rooms;
-
apartments;
-
bathrooms;
-
corridors;
-
all common areas;
-
at windows;
-
on balconies whenever smoke causes inconvenience or disturbance to other guests.
The use of electronic cigarettes and vaping devices is likewise prohibited inside guest rooms and all indoor common areas.
Failure to comply with this policy shall result in a fixed compensation charge of €1,000, intended in particular to cover:
-
complimentary breakfasts offered to other guests affected by the disturbance;
-
professional odour treatment;
-
specialised cleaning procedures;
-
sanitisation of textiles and soft furnishings;
-
temporary removal of the accommodation from sale;
-
the resulting loss of revenue.
This fixed compensation shall not limit the Establishment's right to seek additional damages should the actual loss suffered exceed the above amount.
15. PET POLICY
Domestic pets weighing less than 5 kg are welcome exclusively upon prior approval by the Establishment.
A supplement of €25 per pet, per night shall apply.
Pets must remain under the continuous supervision of their owner.
They may not be left unattended in guest rooms or apartments.
Pets must be kept on a leash at all times in the common areas.
For hygiene reasons, pets are not permitted in breakfast or dining areas.
Owners remain fully liable for any damage, nuisance or disturbance caused by their pets.
The Establishment reserves the right to refuse any animal whose behaviour is considered dangerous, disruptive or incompatible with the comfort and safety of other guests.
16. DAMAGE AND GUEST LIABILITY
The Client shall be fully responsible for any damage caused by themselves, their accompanying guests, or any animal under their care during the stay.
Any damage to the Establishment, its facilities, furniture, equipment or fixtures shall give rise to additional charges, including but not limited to:
-
the cost of repairs;
-
replacement of damaged equipment or furnishings;
-
restoration costs;
-
specialised cleaning services;
-
administrative costs incurred in processing the claim;
-
loss of revenue resulting from the temporary unavailability of the accommodation until it is restored to its original condition.
Where the actual loss exceeds the amount initially charged, the Establishment reserves the right to seek full compensation for all damages incurred.
The Client expressly authorises the Establishment to charge the payment method used to secure or pay for the reservation for any outstanding amounts due, in accordance with applicable law.
17. PERSONAL BELONGINGS
The Client remains solely responsible for their personal belongings throughout the duration of their stay.
Guests are responsible for ensuring that their accommodation is properly secured and for safeguarding their personal property.
The Establishment shall not be held liable for the loss, theft or damage of personal belongings except where liability is expressly provided for under the mandatory provisions of French law applicable to hotelkeepers.
Items left behind may be retained by the Establishment for a period of six (6) months.
Shipping costs for returning forgotten items shall be borne exclusively by the Client.
If no claim is made within one (1) year, the Establishment reserves the right to dispose of the items or donate them to a charitable organisation in accordance with its internal procedures.
18. LIABILITY OF THE ESTABLISHMENT
The Establishment undertakes to use all reasonable efforts to ensure the proper performance of the services booked by the Client.
However, the Establishment shall not be held liable for any loss, damage or inconvenience arising from:
-
improper or inappropriate use of the facilities by the Client;
-
loss or theft of personal belongings where liability is excluded by law;
-
temporary interruptions to water, electricity, internet or telecommunications services beyond the Establishment's control;
-
construction or maintenance works carried out in the vicinity by third parties;
-
exceptional disturbances beyond the Establishment's control;
-
any event qualifying as force majeure.
Under no circumstances shall the Establishment be liable for indirect damages, loss of profits, business interruption, loss of opportunity or any consequential or intangible losses suffered by the Client.
19. FORCE MAJEURE
Neither party shall be held liable where the performance of its contractual obligations is prevented, delayed or rendered impossible, in whole or in part, by an event of force majeure.
For the purposes of these Terms and Conditions, force majeure shall have the meaning set out in Article 1218 of the French Civil Code, including but not limited to:
-
natural disasters;
-
fire;
-
flooding;
-
storms;
-
war;
-
terrorist attacks;
-
riots or civil unrest;
-
pandemics or epidemics;
-
governmental or administrative decisions preventing the operation of the Establishment;
-
nationwide strikes external to the Establishment;
-
widespread interruption of energy or telecommunications networks;
-
or any other unforeseeable, irresistible and external event beyond the reasonable control of the parties.
During the occurrence of such event, the affected contractual obligations shall be suspended for the duration of the force majeure event.
20. EXCEPTIONAL RELOCATION
Should the reserved accommodation become exceptionally unavailable due to circumstances beyond the reasonable control of the Establishment, including but not limited to fire, major technical failure, exceptional events or any other legitimate cause, the Establishment reserves the right to offer the Client:
-
accommodation of an equivalent or higher category;
or
-
a full refund of all sums paid where no satisfactory alternative accommodation can reasonably be arranged.
Except where otherwise required by mandatory law, the Client shall not be entitled to any additional compensation or damages.
21. INTERNET ACCESS – WI-FI
Complimentary Wi-Fi access is provided throughout the Establishment for the convenience of its guests.
The Client undertakes to use the internet service in full compliance with applicable French laws and regulations.
In particular, the Client agrees not to:
-
download, upload or distribute any unlawful content;
-
infringe any intellectual property rights;
-
use the network for fraudulent, malicious or illegal purposes;
-
attempt to access, interfere with or compromise the Establishment's computer systems, servers or network infrastructure.
The Client shall remain solely responsible for all activities carried out through the internet connection made available by the Establishment.
22. PERSONAL DATA
Personal data collected during the reservation process are processed by SARL L'ARTISTE exclusively for the following purposes:
-
managing reservations;
-
performing the accommodation contract;
-
processing payments and issuing invoices;
-
complying with legal and regulatory obligations;
-
improving the quality of the services provided;
-
communicating with the Client before, during and after the stay.
Such processing is carried out in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) and all applicable French data protection legislation.
The Client has the right to access, rectify, erase, restrict or object to the processing of their personal data, as well as the right to data portability, under the conditions provided by applicable law.
Any request relating to personal data may be submitted to the Establishment by post or by email.
To ensure the safety and security of guests, staff and property, certain common areas of the Establishment may be monitored by a video surveillance system in accordance with applicable legislation.
23. IDENTITY VERIFICATION AND FRAUD PREVENTION
In accordance with applicable legislation and as part of its fraud prevention policy, the Establishment may require the Client, upon arrival, to present:
-
a valid government-issued identification document; and
-
the payment card used to secure or pay for the reservation.
Where the cardholder is not present upon check-in, the Establishment reserves the right to request an alternative method of payment or any supporting documentation reasonably necessary to verify the legitimacy of the transaction.
Should the Establishment have reasonable grounds to doubt the identity of the Client, the origin of the funds or the authenticity of the payment method presented, it reserves the right to refuse access to the accommodation or cancel the reservation, without prejudice to any legal action available under applicable law.
24. EXCEPTIONAL CLEANING AND REINSTATEMENT OF ACCOMMODATION
The reservation price includes cleaning corresponding to the normal and reasonable use of the accommodation.
Where a guest room, apartment or Penthouse is returned in a condition requiring exceptional cleaning or reinstatement, including but not limited to:
-
excessive or abnormal dirtiness;
-
significant accumulation of waste;
-
extensive cleaning of kitchen facilities or appliances;
-
substantial stains affecting furniture, textiles or floor coverings;
-
persistent unpleasant odours;
-
or any restoration exceeding the scope of standard housekeeping services,
the Establishment reserves the right to invoice the Client for the actual costs incurred, based on supporting documentation or an itemised quotation.
Such charges shall be independent of any compensation that may be due for damage to property or loss of revenue.
25. INTELLECTUAL PROPERTY
All content published or made available by the Establishment, including but not limited to photographs, texts, logos, trademarks, videos, brochures, graphic elements and digital content, shall remain the exclusive property of SARL L'ARTISTE or of its respective partners.
Any reproduction, representation, distribution, publication, adaptation or use, in whole or in part, by any means whatsoever, without the prior written authorisation of the rights holder, is strictly prohibited and may give rise to legal proceedings.
26. COMPLAINTS
Any complaint relating to a stay must be submitted to the Customer Service Department of Traverse des Artistes as soon as reasonably possible, either by post or by email.
To facilitate the prompt handling of the request, the Client is kindly invited to provide:
-
their full name;
-
their reservation number;
-
the dates of their stay;
-
a detailed description of the complaint;
-
any supporting documents or evidence deemed relevant.
The Establishment undertakes to review each complaint with due care and to provide a response within a reasonable timeframe.
27. CONSUMER MEDIATION
In accordance with Articles L.611-1 et seq. of the French Consumer Code, any Client who has first contacted the Customer Service Department of SARL L'ARTISTE and has not received a satisfactory response within one (1) month may refer the matter, free of charge, to the Tourism and Travel Mediation Service.

28. GOVERNING LAW AND JURISDICTION
These General Terms and Conditions of Sale shall be governed by and construed in accordance with the laws of France.
The parties agree to make every reasonable effort to resolve any dispute amicably before initiating legal proceedings.
Failing an amicable settlement, any dispute arising out of or in connection with these Terms and Conditions shall be submitted to the competent French courts in accordance with the applicable statutory provisions, including those of the French Consumer Code.
29. AMENDMENTS TO THE GENERAL TERMS AND CONDITIONS
SARL L'ARTISTE reserves the right to amend these General Terms and Conditions of Sale at any time.
Any amended version shall apply exclusively to reservations made after its publication.
The applicable Terms and Conditions shall be those accepted by the Client at the time of confirmation of the reservation.
30. ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS
Any reservation made with Traverse des Artistes constitutes the Client's full, unconditional and irrevocable acceptance of these General Terms and Conditions of Sale.
By confirming a reservation, the Client acknowledges having read, understood and accepted all of the provisions contained herein and undertakes to comply with them throughout the duration of their stay.
